Treace Medical Concepts and Fusion Orthopedics announced they have come to an amicable resolution of previous litigation between the two parties.
Treace filed the lawsuit on March 29, 2022 against Fusion Orthopedics in Arizona alleging patent, trademark, and copyright infringement. The company also alleged a number of unfair trade practices concerning Fusion’s use, sale, and promotion of the Lapilock 4D advanced bunion surgery including false advertising and unfair competition.
Treace aimed to receive injunctive relief and damages from the lawsuit.
Fusion then filed counterclaims against Treace to request declaratory judgment of non-infringement and the invalidity of the patents, declaratory judgment of the invalidity of Treace’s Lapiplasty trademark, and various unfair practices based on Treace’s use, sale, and promotion of Lapiplasty 3D bunion correction. This included counterclaims of false decsriptions and false advertising.
The terms of the settlement were not released, but Fusion Orthopedics reported being pleased with the outcome in a press release.
